Tonchidot Corporation, (“Tonchidot”, “we” or “us”) provides software and related Services called Sekai Camera that are accessible by mobile devices (the “Services”). By accessing, browsing, posting, uploading, or in any way using the Services, you agree to the following terms, our separate Services Agreement, and all other guidelines and policies referenced herein (collectively, the “Agreement”).
This privacy policy applies to your use of the Sekai Camera application and Services, but does not apply to any third party sites that may be linked to them.
You are required to agree to the following to use Sekai Camera application and Services:

BY USING THE SEKAI CAMERA APPLICATION AND SERVICES, YOU AGREE TO BE BOUND BY THE TERMS OF THIS PRIVACY POLICY. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE DO NOT USE THE SEKAI CAMERA APPLICATION AND SERVICES.
0. Definitions
(1)The terms “we”, “us”, “our”, and “Tonchidot” refer to Tonchidot Corporation, a company incorporated in Japan.
(2)The term “Services” refers to the Sekai Camera application and Services.
(3)The terms “you” and “your” refer to you, the user of any of Sekai Camera’s Services.
(4)The term “personal information” means information that you provide to us that personally identifies you, such as your name, e-mail address, and any other data related to such information.
(5)The term “user” is someone who accesses, browses, posts, uploads, or in any way uses the Services. “You” and “your” refer to you, the user of the Services.
(6)The term “Content” means text, photos, voice, audio, music, graphics, images, and all other forms of data.
(7)The term “Your Content” means Content that you submit or transmit to or through the Services, such as comments, reviews, and information about your profile. The term “User Content” means Content that users submit or transmit to or through the Services.
(8)The term “Third Party Content” means Content that is made available on the Services by parties other than Tonchidot or its users, such as data providers who license data to Tonchidot for use on the Services.
1. Information Collection and Use
We collect and store the following information, some of which may be personal information:
1.1 Account Information: If you create an Account to use the full range of Services offered on Sekai Camera, such as posting (not just browsing) various Content, we will ask you to provide personal information for our records, such as your name and e-mail address. To create an Account, you are required to freely choose your Account ID. Your Account ID is important in administering our services, and we strongly advise users not to forget their Account ID. You may use any fictitious name for your Account ID to reduce the risk of being personally identified. However, we require a real e-mail address to communicate with you in administering our Services, and to send you updates and news. In the event that the e-mail you have provided us is not valid, or for any reason is not capable of delivering updates to you, we may not have any means to communicate with you or confirm your identity. Please note that in such cases, it may become difficult to cater to requests such as deleting certain Content that you have created, but which you later wish to erase.
1.2 UDID Information: Even if you do not create an Account and use the Services just for browsing purposes, we will still be obtaining UDID (Unique Device Identifier) information that is specific to the mobile handset when you access our Services. UDID information may be used to identify, block, or terminate usage of the mobile handset when users do not comply with our Services Agreement and/or Privacy Policy.
1.3 Your Content: Your Content are information that you submit or post to the Services such as text, photos, voice, and the information that you input as part of your Account profile. Our Services will publically display Your Content, which will be displayed together with your Account name. Your Content will be stored and displayed on our Services for an indefinite period of time. If you include any personal information in Your Content (such as your name or a photo of yourself), other users may be able to identify you. Therefore, you should absolutely not include information in Your Content that you wish to keep private.
1.4 Location Information: Our Services will also display the location data of the place where Your Content was posted. You will not be able to disable this feature, so if you do not want the public to know where you are or where you have been, you should not post any Content at all.
1.5 Log Data: We will record information relating to your use of the Services, such as timestamp and location information of Content you post, view, comment, and pocket. We use this information to provide the Services to you, and to perform analyses of user behavior to measure usage of the various features of the Services.
1.6 Feedback: Whenever you contact us to provide feedback or ask questions, we will record any personal information and other Content that you provide in your communication so that we can respond effectively.
2. Controlling Your Personal information
Even if you close your Account, we will not be obligated to delete any or all of Your Content, and they may continue to be displayed on the Services. Please note that even when you delete or change any of your personal information or any of Your Content so that they are no longer displayed on our Services, we may still retain such information in our systems.
2.1 Deleting Personal information: You can delete your e-mail address information at any time. However, in such cases, we may not have any means to communicate with you or confirm your identity, whereby it may become difficult to cater to requests such as deleting certain Content that you have created, but which you later wish to erase.
Currently, you are not able to change the initially registered Account ID, but you are able to change your nickname and password.
2.2 Deleting Your Content: Other than cases where we delete Your Content due to violation of our Services Agreement and Privacy Policy, only you and no one else will be able to delete the Content that you created and posted yourself. Please note that the act of deleting Your Content may prove to be difficult after you have physically moved from the location you posted the Content, since you may be required to be at the specific location to identify and delete them.
Please be aware that in the event that you include any personal information in Your Content, other users may be able to identify you. The location information contained in the Your Content will also enable other users to see where you have been. Therefore, you should absolutely not include information in Your Content that you wish to keep private.
In the case that you are not able to delete any or all of Your Content that you want deleted, you may contact us to perform it for you. In this case, we shall request specific information from you to confirm your identity. However, if you cannot provide the specific information we require, we will not be able to delete any Content. We may also charge you a fee to answer your request to cover our costs; however, we will advise you of any fee in advance, which will be no more than any maximum fee allowed by law.
3. Information Sharing and Disclosure
3.1 Sharing with Third Parties: We may distribute Your Content to third parties, as permitted pursuant to our Services Agreement. The third parties may in turn publically display or publish Your Content in connection with their own web sites and media platforms. When we distribute Your Content to third parties, we will include your nickname (but not your personal information unless you include your personal information in Your Content).
In the future, we may utilize third party advertising companies to deliver advertisements when you visit the Services. These advertizing companies may use information about your usage to better provide advertisements of interest to you.
We also reserve the right to share your personal information with third parties to conduct quality assurance, and provide technical and customer support. In addition, subject to your approval and instruction, we may share your personal information with third parties to provide you with features that we offer through the Services, such as linking your contact information with other services and software applications, or facilitating creation of new Accounts. These third parties will be required not to use your personal information other than to provide the Services that you requested.
3.2 Sharing with Affiliates: We may also share your personal information with our parent company, subsidiaries, joint ventures, or other companies under our control (collectively, “Affiliates”) that we may have now or in the future, in which case we will require them to honor this Privacy Policy. We may sell, transfer or otherwise share some or all of our assets, including your Personal information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. If another company acquires our company or our assets, that company will possess your personal information, and will assume the rights and obligations with respect to that information as described in this Privacy Policy.
3.3 Compliance with Laws and Law Enforcement: When we believe it to be reasonably necessary, we may use the information we collect in connection with your use of the Services (including your personal information) in order to investigate, enforce, and apply our Service Agreement and Privacy Policy. We may also cooperate with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties if we, in our sole discretion, believe it necessary or appropriate to respond to claims and legal process, to protect our property and rights of any third party, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be, or to pose a risk of being, an illegal, unethical or legally actionable activity.
3.4 Aggregated Information: We may disclose aggregated information to third parties, such as user behavior data and analyses, in pursuing business relationships with advertisers, content providers, distribution partners, and other third parties.
4. Information of Others
4.1 In the future, we may provide a feature where you can invite people to the Services. You may utilize this service to provide us with e-mail addresses of others, so we can invite them to create an Account with us. In providing us with another person’s e-mail address, you represent to us that you have obtained the consent of the person regarding the disclosure to us of their personal information. Please note that we may also disclose such information when necessary in order to comply with any legal process, as explained above.
5. Security
5.1 Your Account is password protected, and we employ industry standard measures to protect the personal information that we store. Please note that you are able to change your nickname password as many times as you wish. We also limit access to your personal information to our employees and contractors who need access to them to perform their respective job functions, such as customer service. Please be aware that although we take appropriate measures to protect your information and safeguard against its unauthorized disclosure, we will not be able to assure you that your personal information will never be disclosed in a way inconsistent with this Privacy Policy.
You hereby acknowledge that Sekai Camera is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
6. Terms and Modifications to this Privacy Policy
6.1 We may modify this Privacy Policy at any time, and we will post any new versions on our web site. If we make any material changes in the way we use your personal information, we will notify you by prominently posting notice of the changes on our web site. Any such changes will be effective immediately following our posting of notice of the changes on our web site. These changes will also be effective immediately for new users of the Services.
6.2 Please note that at all times you are responsible for updating your personal information to provide us with your most current e-mail address. In any event, changes to this Privacy Policy may affect our use of personal information that you provided us prior to our notification to you of the changes. Continued use of the Services following notice of such changes shall indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.
